Novell の特許ポートフォリオ入札に失敗したグーグルが、落札したマイクロソフト、オラクル、アップルなどの企業グループに対して宣戦布告している。

ベッドを共にする
テクノロジー部門で仕事をして20年以上になる。マイクロソフトとアップルはこれまで常に激しく対立してきた。だから彼らがベッドを共にするようになると、いったいどうしたことかと不思議に思う。それはこういうわけだ。
I have worked in the tech sector for over two decades. Microsoft and Apple have always been at each other’s throats, so when they get into bed together you have to start wondering what’s going on. Here is what’s happening:

破竹の Android
Android は燃えている。39 の製造メーカーと 231 のキャリアのネットワークを通じて毎日 55 万台の Android デバイスがアクティベートされている。Android と他のプラットフォームは激しく競い合っている。だから新しいクールなデバイスと驚くべきモバイルアプリが消費者のために産み出されるのだ。
Android is on fire. More than 550,000 Android devices are activated every day, through a network of 39 manufacturers and 231 carriers. Android and other platforms are competing hard against each other, and that’s yielding cool new devices and amazing mobile apps for consumers.

敵対的で組織的な運動
しかしながら Android の成功は別のものを産み出した。敵対的で組織的な運動だ。マイクロソフト、オラクル、アップルなどの企業がインチキな特許によって Android に対する敵対的で組織的な運動を行なっている。
But Android’s success has yielded something else: a hostile, organized campaign against Android by Microsoft, Oracle, Apple and other companies, waged through bogus patents.
彼らは一緒になって Novell の古い特許(マイクロソフトおよびアップルを含む CPTN グループ)や Nortel の古い特許(マイクロソフトおよびアップルを含む Rockstar グループ)を取得し、グーグルが取得するのを妨げている。Android デバイス1台につき 15 ドルのライセンス料を取り立てるためであり、Android のライセンスを(無料で)受けて製造しているメーカーのコストが Windows Mobile より高くつくようにするためだ。さらには Barnes & Noble、HTC、Motorola、Samsung などに訴訟を起こすためでもある。特許は技術革新を奨励するためのものだったが、最近では技術革新をさせないための武器として使われている。
They’re doing this by banding together to acquire Novell’s old patents (the “CPTN” group including Microsoft and Apple) and Nortel’s old patents (the “Rockstar” group including Microsoft and Apple), to make sure Google didn’t get them; seeking $15 licensing fees for every Android device; attempting to make it more expensive for phone manufacturers to license Android (which we provide free of charge) than Windows Mobile; and even suing Barnes & Noble, HTC, Motorola, and Samsung. Patents were meant to encourage innovation, but lately they are being used as a weapon to stop it.

特許を利用して税を課す
スマートフォンには 25 万件以上の特許(大部分は疑わしいもの)が関わっているかもしれない。われわれのライバルはこれら疑わしい特許を利用して税を課し、消費者にとって Android デバイスが高くつくようにしようとしている。Android デバイスの製造と販売をより困難にしようとしている。新しい機能をデバイスに持たせることによってではなく、訴訟によって争おうとしているのだ。
A smartphone might involve as many as 250,000 (largely questionable) patent claims, and our competitors want to impose a “tax” for these dubious patents that makes Android devices more expensive for consumers. They want to make it harder for manufacturers to sell Android devices. Instead of competing by building new features or devices, they are fighting through litigation.

反競争的手段
特許のコスト自体も、この反競争的戦術によって実際の価値より大きいものへとエスカレートしている。マイクロソフトとアップルは Nortel の特許ポートフォリオを 45 億ドルで取得したが、これは入札前の予想価格 10 億ドルのほぼ5倍だ。幸い司法は、疑わしい特許を集めて反競争的手段(anti-competitive means)とすることに眉をひそめている。したがってこれらの取引はいずれ規制当局の厳しい調査を受けることとなり、特許バブルもはじけるだろう。
This anti-competitive strategy is also escalating the cost of patents way beyond what they’re really worth. Microsoft and Apple’s winning $4.5 billion for Nortel’s patent portfolio was nearly five times larger than the pre-auction estimate of $1 billion. Fortunately, the law frowns on the accumulation of dubious patents for anti-competitive means — which means these deals are likely to draw regulatory scrutiny, and this patent bubble will pop.

あくまで戦う決意
我々はナイーブではない。テクノロジーはタフで常に変化する産業だ。自らのビジネスに注力して、よりよい製品を作るべく粉骨砕身している。しかし今回は声を大にして我々の立場 — 消費者にとって Android を競争的選択肢とし、その息の根を止めようとするものから防ぐ決意であること — を明らかにすることが重要だと考えた。
We’re not naive; technology is a tough and ever-changing industry and we work very hard to stay focused on our own business and make better products. But in this instance we thought it was important to speak out and make it clear that we’re determined to preserve Android as a competitive choice for consumers, by stopping those who are trying to strangle it.

司法省にもプッシュする
そのため我々は数々の方策を鋭意検討している。司法省に対しては、前述した当該グループに対し Novell の元特許を公正な条件でライセンスさせるよう強制すること、併せてマイクロソフトとアップルが Nortel の特許を取得したのは反競争的手段ではないか検討することを求める。同時に我々は自らの特許ポートフォリオを強化することによって Android に対する反競争的脅威を減らす他の方策も検討している。もし我々が行動を起こさなければ、消費者は Android デバイスの価格高騰に直面する。次の電話を選ぶに際し選択肢が減ることになるのだ。
We’re looking intensely at a number of ways to do that. We’re encouraged that the Department of Justice forced the group I mentioned earlier to license the former Novell patents on fair terms, and that it’s looking into whether Microsoft and Apple acquired the Nortel patents for anti-competitive means. We’re also looking at other ways to reduce the anti-competitive threats against Android by strengthening our own patent portfolio. Unless we act, consumers could face rising costs for Android devices — and fewer choices for their next phone.

複雑な背景の特許訴訟では一方の当事者の言い分を聞くだけでは不十分だろう。

特許関連のニュースは、なんだかな?と思います。
自社の技術を守るために特許があると思っていました。
高額で売買されるんですね、そして、ライバルを威嚇する道具とするように見えるのは私だけでしょうか。?googleも高額で買をうとしたし、買っているようですから、アップルやマイクロソフトをインチキ呼ばわりするのはどうかと思う。

昨今の特許攻防戦のニュースを見ていると、いっそ全て無くしたら?という気持ちになります。
グーグルが、特許は技術革新を奨励するためのものという原則に則って行動するなら、アップルの発明をどう扱うのが筋なのでしょうか?
ボタンを無くし全体を画面とした携帯、タッチパネルで操作し、スタイラスでなく指を用いる、機能をアプリとしてホーム画面に並べる…これらが無ければ、そもそもAndroidなんて存在しない筈ですが。
よそのサイト(TechCrunchなんですが)の記事ですが。
MS側が「今回の入札連合にあんたら(グーグル)も誘ったのに
断ってきたのそっちでしょ。」
って内実ばらしのツイートしてるそうですね。
