GTAT はアップルが決めた日に行なった発注を受け入れ、かつ実行しなければならない。もし如何なるものであれ遅滞が生じた場合は、GTAT は（自らの負担で）緊急配送の措置を講じるか、あるいは（自らの負担で）代替品を購入しなければならない。もし GTAT の納入が遅れた場合は、約定損害賠償金としてサファイアの１ブール当たり 32 万ドル（サファイア材質の１ミリメーター当たり 77 ドル）を支払わなければならない。この数字は１ブールが２万ドル未満であることを前提に算出されたものである。また一方アップルは GTAT に補填することなく、いつの時点においても発注の全体ないしはその一部をキャンセルでき、また如何なる期日に納入すべきか予定を変更できる権利を有する。

GTAT must accept and fulfill any purchase order placed by Apple on the date selected by Apple. If there is any delay, GTAT must either use expedited shipping (at its own cost) or purchase substitute goods (at its own cost). If GTAT’s delivery is late, GTAT must pay $320,000 per boule of sapphire (and $77 per millimeter of sapphire material) as liquidated damages to Apple. To put this figure in perspective, a boule has a cost of less than $20,000. Apple, however, has the right, without compensating GTAT, to cancel a purchase order in whole or in part at any time and reschedule a delivery date at any time.

嘘つき

NY タイムズの Op-Ed 欄で、Joe Nocera は Cook のことを嘘つき呼ばわりしている。

On the New York Times Op-Ed page he calls Apple CEO Tim Cook a liar.

アップルに関する Nocera のいちばん新しいコラムで特筆すべきは、彼が Tim Cook のことを嘘つきと呼んだことだ。宣誓にも関わらず Cook が「大ウソ」（whopper）や「真っ赤なウソ」（flat-out lie）をついたと非難している。

But what will be remembered about Nocera’s latest Apple column is that he called Tim Cook a liar — accusing him of telling, under oath, a “whopper” and a “flat-out lie.”

Cook 証言をほんとに見たのか

そう非難するのは Cook の証言を見た後であることを、Nocera は明言しないまでも暗に匂わせている。

Nocera implies, but doesn’t actually say, that he makes those charges after watching Cook’s testimony.

私も Cook の証言を見た、それも２度も。Nocera がほんとに見たとはとても信じられない。彼が引用している書類や記事も読んだが、事実関係で彼が Cook と違うのは、むしろ Nocera の方が間違っているのではないかと思う。

I watched Cook’s testimony — twice. I find it hard to believe that Nocera saw any of it. And having read the documents and news articles he cites, I believe that on the points with which he has factual disagreements with Cook, he’s provably wrong.

As I say, Nocera has a long history with Apple — a history, in his defense, that includes being told some flat-out lies. The biggest whopper was probably the one Steve Jobs told him in 2008 when, according to Nocera, Jobs assured him that he didn’t have cancer.

Cook の議会証言について第一印象を書いたときはまだ証言ビデオを見ていなかった。

その後 C-SPAN ビデオで詳しく見ることができた。NY タイムズのライブブログでは分からない細かいニュアンスがよく分かる。

老練な政治家が大企業トップをギリギリ絞り上げる様子がよく見て取れる。Cook とそのチームは誠実かつ真摯に対応していると思う。

米上院常設調査小委員会の追求のポイントは、アップルが本来収めるべき税金をアイルランドの子会社という隠れ蓑を使って不当に隠したという点にある。

Cook チームはなんら税法に違反するところはないと何度も繰り返し主張する。小委員会は最後までそれを崩せない。

一時休憩にはいるまでの２０分間はなかなかの見ものだ。

Nocera 記者の記事は米上院小委の側に立って書いているとしか思えない。［追記：というか、同小委がアップルの脱税疑惑をとりあげるキッカケになったのは NY タイムズの記事だったともいわれる。］

NY タイムズ自身が、「ライオンの巣窟」に入ったが最後には 「Cook に手なずけられた」と書いたも関わらず、更に尚 Cook は嘘つきだと追い討ちをかけたのはなぜなのか。そこに何らかの意図を感じずにはいられない。

Nocera の記事を批判したのは Elmer-DeWitt だけではない。TUAW もさらに詳しくその間違いを追求している。

ひと昔前なら大新聞の記者が書けばそれでまかり通った。

しかしあまりにヒドすぎる内容は大新聞といえどもみんなが見過ごさなくなった。

大新聞に比べればマイナーなブロガーたちも今や黙ってはいない・・・今回の顛末を見てそんなことを考えた。

いわゆるアジアのサプライヤー筋の情報はアップル系ウワサの貴重な情報源だ。ほとんどが Digitimes の独壇場といえる。

最近の「今年の第３四半期には 799 ドル のMacBook Air が出る」というウワサも Digitimes 情報だった。

これまでの Digitimes ネタを Harry McCracken が徹底的に追跡、Digitimes は狼少年でまったく信用できないと結論している。

要するに、Digitimes が時に間違いを犯すというのではない。アップルのビッグニュースに関する限り、ほとんどは間違いだ。まったくの見当外れもある。Digitimes はこういってきた。彼らの情報筋によればアップルは AMD プロセッサ搭載の MacBook を出すだろうと。それだけではない。タッチスクリーン iMac、プロジェクター内蔵 iPhone、OLED ディスプレイ iPad などを出すともいっていきた。これらの製品は — Digitimesが報じた他の製品同様 — 未だに登場していない。

But the thing is, Digitimes isn’t just wrong some of the time. When it comes to the big Apple stories, it’s wrong most of the time. Sometimes wildly so. It’s reported that its sources had said that Apple was going to release MacBooks with AMD processors, iMacs with touch screens, iPhones with built-in projectors and iPads with OLED displays. Those products, and others mentioned in Digitimes articles, never showed up.

McCracken は Digitimes が報じた 25 のアップル予想を取り上げる。16 はまったくの的外れだった。

McCracken looked at 25 Digitimes predictions about Apple. Sixteen of them turned out to be wildly off base.

Harry McCracken のいうことに私は完全に同意する。アップルの話題を取り上げるジャーナリストは Digitimes が書くことにはもっと慎重になるべきだ。別のソースで証明されない限り・・・

I completely agree with Harry’s assessment: journalists writing about Apple need to take a much more critical view of what Digitimes says until it’s independently verified.

無限に繰り返されるウワサのひとつにアップルがテレビを出すというものがある。

鴻海の Terry Gou 会長が Foxconn で iTV を準備中と発言したというのでみんなが飛びついた。China Daily が報じたものだ。

このニュースの報道ぶりについて Philip Elmer-DeWitt が徹底的批判をしているのがオモシロい。

「これらの記事のどれも触れていないこと — それは Terry Gou が最も口の固いお偉いさんのひとりだということだ。彼の工場では世界の家電製品の 40% を組み立てている。世界で最も価値のあるエレクトロニクスメーカーがこれから出す製品 — その内情に彼は通じている。アップルのみならず、ソニー、マイクロソフト、HP その他のメーカーについても・・・。Gou は秘密を漏らさないということで業務提携先の信頼を得ているのだ。」

What none of these reporters mentioned (or apparently bothered to consider) is that Gou — whose factories assemble 40% of the world’s electronic devices — is one of the industry’s most secretive executives. He is privy to the future product plans of the most valuable electronics brands — not just Apple, but also Sony, Microsoft, Hewlett-Packard and the rest. He is trusted by his business partners because he never leaks their secrets.

Digitimes だろうと China Daily だろうと、その情報源は結局は Foxconn ないしはその関連ということだろう。

さすればサプライヤー筋情報といえども、その中枢からウワサが漏れるわけはないということか・・・
