アプリ内課金のライセンス料を iOS デベロッパに要求しようとする Lodsys のパテント・トロール［patent troll：特許恐喝、特許ゴロ、特許荒らし］が物議をかもしている。
デベロッパのひとりは Lodsys をプレデターと呼ぶほどだ。
ついにアップルが腰を上げた。

アップルは５月２３日（月曜日）付けの Lodsys に対する手紙［全文］で、Lodsys がアプリ開発者に同社の技術をライセンスするよう要求した手紙を撤回することを求めた。
In a letter sent to Lodsys on Monday, Apple asked that the company withdraw letters sent to app developers demanding they license the technology.
「アップルがこれら特許のライセンスを受けていること、およびアプリ開発者（App Makers）がそのライセンスにより保護されていることに議論の余地はない。」と Bruce Sewell［アップル上級副社長・法律顧問］は述べている。
“Apple is undisputedly licensed to these patents and the App Makers are protected by that license,” wrote Bruce Sewell, Apple Senior Vice President and General Counsel.

アプリ内課金を可能にする技術
Lodsys は複数の iOS デベロッパに対し 2011 年５月１３日付けで、彼らがアプリ内課金を可能にする Lodsys の技術をライセンスすべきとの手紙を送りつけた。しかしデベロッパたちは、アップルが同ライセンスを取得してそれをアプリ内課金を行なう方法として提供している以上デベロッパはそれを利用できるはずだと考えた。
Lodsys sent a letter to several Apple iOS developers on May 13, 2011 claiming that they had to license the company’s technology, which allowed for in-app purchases. However, developers felt that because Apple licensed the technology and offered it as a way to provide its users with in-app purchases, they should be able to use it.
アップルも同じ考えだ。
Apple feels the same way.

アプリ開発者は保護される
Sewell の手紙によれば、「したがって貴社の手紙が問題としている技術は、アップルがアプリ開発者に対し提供するため Lodsys からライセンスしたものであることは明確である。これらのライセンスを受けた製品およびサービス、すなわちアップル自身がライセンスを受けたハードウェア、ソフトウェア、API、メモリー、サーバーおよび App Store を含むインターフェイスを利用することによって、アプリ開発者がエンドユーザーと連絡をとることことが可能になる。アップルがかかる技術をアプリ開発者に提供するというライセンスを Lodsys から取得しているのだから、アプリ開発者は Lodsys が主張するような特許権侵害なしに同技術を利用する権利がある。」
“Thus the technology that is targeted in your notice letters is technology that Apple is expressly licensed under the Lodsys patents to offer to Apple’s App Makers,” wrote Sewell. “These licensed products and services enable Apple’s App Makers to communicate with end users through the use of Apple’s own licensed hardware, software, APIs, memory, servers, and interfaces, including Apple’s App Store. Because Apple is licensed under Lodsys’ patents to offer such technology to its App Makers, the App Makers are entitled to use this technology free from any infringement claims by Lodsys.”

アップル法務が乗り出したことで、Lodsys の「脅迫状」を受け取ったデベロッパの間では安堵の気持ちが漂っているようだ。

いつものパターン
iOS デベロッパを特許侵害で脅していた Lodsys に対し、アップルが今日発出した回答はいつものパターンにそったものだ。
Apple’s response today to the Lodsys patent threat against iOS developers is another example that indicates a consistent pattern:
１）アップルに関係する問題が起きる。
２）途端に大騒ぎとなり、様々な憶測がなされる。
３）一、二週間後アップルの答えがでる。一旦出た答えは断固として反論の余地がないものだ。
1. An Apple-related crisis or problem occurs.
2. There’s an immediate flurry of news coverage and speculation.
3. A week or more passes before Apple responds, but when they do, they do so decisively.

今度はこれだ
iPhone 4 の「アンテナゲート」も、iOS の位置情報プライバシーも同じパターンだった。そして今度はこれだ。Lodsys が iOS デベロッパに対し脅迫状を送り始めてからたったの１０日だ。その間に２度の週末も含まれる。それでも Lodsys の脅迫状を受け取った複数の友人たちの話から、この１０日間が長い１０日間だったことを知っている。訴訟はやっかいない問題だ。それに App Store はアップルの最も重要な資産だ。
Same pattern for the iPhone 4 “antennagate”, the iOS location-logging database, and now this. It has only been 10 days since Lodsys began sending its threats to iOS developers, and that includes two weekends. I know from talking to several friends who were on the receiving end of Lodsys’s threats that those were a long 10 days, but still. Litigation is serious business, and the App Store is one of Apple’s crown jewels.

確信をもって
アップルのポリシーは危機に対しては確信をもって（少なくとも可能な限りの確信をもって）臨むことだ。確信を持つためには時間がかかる。アップル広報がくだらぬ文言を垂れ流すこともない。まずは沈黙、そして答えだ。このやり方はうまくいっているのではないだろうか・・・
Apple’s policy is to respond to a crisis with certainty, or at least as much certainty as can be mustered. Certainty takes time. No drip, drip, drip of vapid PR statements. Just silence, then an answer. Seems to be working out pretty well for them.
